Overtime pay in Turkey is governed by article 41 of Labour Law No. 4857: every hour worked beyond the statutory weekly working time of 45 hours must be paid at a premium over the normal hourly wage. This tool derives your hourly wage from your monthly gross salary and calculates the gross overtime amount you are owed. It supports both overtime work paid at a 50% premium and work at extra hours paid at a 25% premium — a distinction that matters if your contract sets a working week shorter than the legal limit.

How is it calculated?

Three steps:

  1. The hourly wage is found by dividing the monthly gross salary by 225 hours — the established monthly equivalent of the 45-hour legal working week, also applied by the Turkish Court of Cassation in overtime disputes.
  2. The premium rate depends on the type of work: 50% for overtime work (hours beyond the 45-hour statutory week) and 25% for work at extra hours (hours above the contractual working time but still within the statutory limit).
  3. The amount is hourly wage × overtime hours × (1 + premium rate). Intermediate values and the result are rounded to the kuruş.

The result is a gross figure: social security premiums and income tax depend on your cumulative payroll tax base, so the net amount that reaches your account varies from person to person and from month to month.

Example

A foreign software engineer working in Istanbul on a Turkish employment contract puts in several extra evening hours during a release crunch. Entering the base gross salary from their payslip together with the overtime hours, they see the hourly wage, the premium hourly rate and the total gross overtime amount in the breakdown. Had their contract set the working week below the statutory 45 hours and had the extra hours stayed within that limit, the same hours would count as work at extra hours and the lower 25% premium would apply. Frequently asked questions

How is overtime pay calculated in Turkey?

The monthly gross salary is divided by 225 to obtain the hourly wage; that wage is increased by 50% for overtime work — or by 25% for work at extra hours — and multiplied by the number of extra hours worked. The result is a gross amount; deductions depend on your individual payroll.

What is the difference between overtime work and work at extra hours?

Overtime work (fazla çalışma) is work beyond the statutory 45-hour week and is paid with a 50% premium. Work at extra hours (fazla sürelerle çalışma) applies when the contract sets a weekly working time below 45 hours: hours between the contractual time and 45 hours are paid with a 25% premium.

What is the maximum number of overtime hours per year in Turkey?

270 hours per year, set by article 41 of Labour Law No. 4857. This cap cannot be exceeded even with the employee's written consent; if your employer routinely goes over it, keep records of your hours and consider seeking legal advice.

Is overtime pay taxed in Turkey?

Yes. Overtime pay is part of the gross wage and is subject to social security premiums, unemployment insurance, income tax and stamp duty like the rest of your salary. Because the net amount depends on your cumulative income tax base in that month, this tool deliberately shows the gross figure.

Why is the monthly salary divided by 225 hours?

225 hours is the established monthly equivalent of the 45-hour statutory working week and is the standard divisor for deriving the hourly wage in Turkish payroll practice. If your employment contract states an hourly wage explicitly, the figure on your payslip takes precedence.

Can I take time off instead of overtime pay in Turkey?

Yes. Instead of the premium payment, an employee may choose one and a half hours of free time for every hour of overtime worked (Labour Law art. 41/4). The employer must allow this time off to be used within six months, during working hours and without a pay cut.

Does weekend or public holiday work count as overtime?

No — it is regulated separately. Work on the weekly rest day and on national and public holidays falls under different articles of the Labour Law (arts. 46–47) with their own premium rules; this tool covers only overtime work and work at extra hours under article 41.
